Prosecutorial Council of Bosnia and Herzegovina (HJPC) EU’s
Pre-Accession Assistance Project (IPA 2017)
- Expert Advisor for 'Rule of Law' Analysis and Trial Monitoring

Length of contract: The temporary post is foreseen for a period of 10 months starting from May/ June 2019

The expert advisor position is thought to temporarily reinforce the office of the Senior Legal Advisor for EU integration matters within the HJPC aiming at bolstering the activities notably on corruption and other serious crime case monitoring as well as justice surveys under the ongoing IPA project 2018/387-166 'Building an Effective and Citizen-friendly Judiciary'.
The future post holder will have the following non-exhaustive list of duties and tasks:
- Analysis on the state of the 'Rule of Law' reform in Bosnia and Herzegovina, particular on how effectively the domestic 'Rule of Law' system functions;
- Contribute to the design and the implementation of future justice surveys in Bosnia and Herzegovina;
- Selection of proceedings for trial monitoring and review of selected closed cases;
- Observing and reporting from public court proceedings concerning the compliance with fair trial standards, the effectiveness of the judicial function and the consistency of the application of the law;
- Evaluation of statistical data generated from the Case Management System for the judiciary and the prosecution service (CMS/ TCMS) in Bosnia and Herzegovina;
- Meetings with judicial office holders and relevant stakeholders for fact finding and verification purposes;
- Provision of technical advice to the HJPC Secretariat on the above issues in line with EU standards and best practices in EU Member States, incl. any further support measures required within the framework of the IPA Direct Grant Project;
- Provision of analytical inputs to EU Delegation/EU Special Representative and the European Commission's services on the above issues;
- Close cooperation with the EU Delegation/EU Special Representative with the aim of ensuring that the conducted analysis and monitoring activities contribute to the EU integration process of Bosnia and Herzegovina in the 'Rule of Law' area;
- Closely liaise with the EU Delegation/EU Special Representative and seek their guidance as regards issues related to policy coordination.
The expert advisor will be bound by the principles of non-interference and objectivity which define that any observations and findings from standard-based trial monitoring are not be directed at influencing the course of justice in specific cases, but address general trends and aim at systemic improvements.
The International Expert Advisor for 'Rule of Law' Analysis and Trial Monitoring shall fulfil the following requirements:
Mandatory requirements:
- EU citizenship;
- Law degree and preferably a background in criminal law;
- Previous experience of at least 10 years working in a domestic judicial environment or international organisation active in the 'Rule of Law' area;
- Very good knowledge of the EU integration process, particularly of accession requirements in the 'Rule of Law' area;
- Proven analytical and drafting skills;
- Highest level of confidentiality and ethical standards;
- Excellent verbal and written expression skills in English;
- Good communication skills;
- Experience in working in multicultural environments.
Advantages:
- Knowledge of the BiH judicial system, including of the HJPC and its jurisdiction;
- Being either a practitioner (judge, prosecutor, attorney) with experience in handling complex crime cases or being a 'Rule of Law' expert with previous provisional experience in qualitative assessment of the performance of judicial systems in processing complex crime cases;
- Previous experience in working on the judiciary in the Western Balkans;
- Advanced university degree.
